1. Acceptance of these Terms

By creating an account or otherwise using the Platform, you agree to be bound by these Terms and by our Privacy Policy. If you use the Platform on behalf of an organisation, you represent that you are authorised to bind that organisation, and "you" refers to that organisation. If you do not agree, do not use the Platform.

2. Definitions

• Individual — a user who takes tests, contests and educational content for personal use.
• Provider — a driving school, instructor, agency or safety professional who publishes content, coaches or sells resources.
• Organisation — an entity that assigns tests to members and tracks their compliance.
• Partner — an approved collaborator working with Drivathon under a separate arrangement.
• Content — any material available on or uploaded to the Platform, including tests, lessons, videos, links and resources.
• Wallet — the in-app balance used to pay for and receive value on the Platform.

3. Eligibility and accounts

You must be at least 18 years old to use the Platform. You agree to provide accurate information, keep it up to date, and keep your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorised use.

We may refuse, suspend or terminate accounts at our discretion, including where we reasonably believe these Terms have been breached.

4. Roles on the Platform

The Platform supports several roles — individual, provider, organisation and partner — each with different features and responsibilities. Some features are only available to certain roles, and additional terms may apply to providers, organisations and partners. You agree to use only the features appropriate to your role and to comply with any role-specific requirements.

5. Acceptable use

You agree not to:

• Break any law or regulation, or infringe anyone's rights.
• Cheat, manipulate results, impersonate others, or use another person's account.
• Upload malicious code, or attempt to disrupt, probe or gain unauthorised access to the Platform.
• Copy, scrape, resell or redistribute Content without authorisation.
• Post unlawful, misleading, offensive or harmful material.
• Use the Platform to send spam or unsolicited marketing.

6. Assessments, contests and results

The Platform provides tests, CBT exams and contests for learning, practice and evaluation. Results reflect your performance on the Platform and are not, by themselves, an official driving licence, certification or legal authorisation to drive. You are responsible for meeting the licensing and legal requirements of your jurisdiction. We aim for accuracy but do not warrant that any test or its content is error-free or suitable for a particular purpose.

7. Educational content and marketplace

Providers may publish educational content and list resources. Drivathon provides the marketplace but is not the author of provider content and does not guarantee its accuracy, quality or outcomes. Transactions for content or services are between the buyer and the provider, subject to these Terms. You are responsible for the content you publish and for ensuring you have the rights to share it.

8. Payments, wallet and refunds

• Payments and top-ups are processed by third-party gateways such as Flutterwave and Paystack. By paying, you also accept those providers' terms.
• The in-app wallet stores value used to pay for features, content and services, and to receive payouts where applicable.
• Prices and fees are shown before you pay. We may change pricing prospectively.
• Except where required by law, payments are non-refundable once a service, test or piece of content has been delivered or accessed. Where a refund is due, it is returned using the original payment method or to your wallet.
• Provider payouts are subject to verification, applicable fees and any minimum thresholds. We may withhold payouts in cases of suspected fraud, chargebacks or breach of these Terms.

9. Intellectual property

The Platform, including its software, design, logos, and Drivathon-created content, is owned by Drivathon or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for its intended purpose. You may not copy, modify, distribute or create derivative works except as expressly permitted.

10. Your content

You retain ownership of the content you upload. By uploading content, you grant Drivathon a worldwide, non-exclusive, royalty-free licence to host, store, display and distribute it as needed to operate and promote the Platform. You are responsible for your content and confirm that it does not infringe any third-party rights or law. We may remove content that breaches these Terms.

11. Organisation and compliance features

Organisations may assign tests, set deadlines and view members' completion and compliance results. If you join an organisation, you consent to your assigned-test results and compliance status being visible to that organisation's administrators. Organisations are responsible for how they use member data and for complying with applicable law.

12. Disclaimers

The Platform is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability and non-infringement. Drivathon does not warrant that the Platform will be uninterrupted, secure or error-free. Content and results are for informational and training purposes and do not replace professional driving instruction, official testing or legal licensing.

13. Limitation of liability

To the maximum extent permitted by law, Drivathon and its officers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill, arising from your use of the Platform. Our total liability for any claim relating to the Platform will not exceed the amount you paid to us in the twelve (12) months before the event giving rise to the claim.

14. Indemnification

You agree to indemnify and hold Drivathon harmless from any claims, damages, losses and expenses (including reasonable legal fees) arising from your use of the Platform, your content, or your breach of these Terms or of any law or third-party right.

15. Termination

You may stop using the Platform and close your account at any time. We may suspend or terminate your access if you breach these Terms or where we are required to by law. On termination, the rights granted to you end, but any provisions that by their nature should survive — such as intellectual property, disclaimers, limitation of liability and indemnification — will continue to apply.

16. Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Platform will be subject to the exclusive jurisdiction of the courts of Nigeria, unless mandatory local law provides otherwise. We encourage you to contact us first so we can try to resolve any issue informally.

17. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Your continued use of the Platform after the changes take effect means you accept the updated Terms.
